Two Domains same names one good one bad, one is mine the other is not. How do I get rid of the bad one?

My name is Jerry F. I own the domain www.jearbear.com But somebody has this same domain only they are using capitol letters in some of the letters such as Www.Jearbear.com So, they were able to create another domain. The problem is my Website sells Boyd bears, this other Website sells . How can I get Www.Jearbear.com removed without effecting my own domain?
